Cancellation and Performance Terms
1. Method of Cancellation
The Client may cancel the service only in writing. The effective date of cancellation shall be the date on which the written notice is received by the Service Provider.
2. Cancellation more than 60 days prior to the event
In the event of cancellation more than 60 days prior to the event date, the booking deposit is non-refundable.
3. Cancellation within 60 days prior to the event
In the event of cancellation within 60 days prior to the event date, the Service Provider shall be entitled, in addition to the deposit, to:
reimbursement of any verified costs already incurred, and
compensation for the capacity and time reserved for the performance of the service,
as well as payment of any instalments that have become due in accordance with the individual agreement.
4. Cancellation within 14 days prior to the event
In the event of cancellation within 14 days prior to the event date, the Service Provider shall be entitled to the full contractual fee, as the service reserved for the specific date cannot typically be replaced by another booking on short notice.
5. Cancellation by the Service Provider and Method of Performance
If the contract is terminated for reasons attributable to the Service Provider, the Service Provider shall refund the deposit in double the amount paid.
The Service Provider is entitled to involve employees and subcontractors in the performance of the service. The Client acknowledges that the personal presence of the Service Provider at the event is not a condition for proper performance, provided that the service is delivered in accordance with the contract and at an appropriate quality level.
6. Payment Schedule
The exact payment schedule and due instalments shall be specified in the individual agreement.
7. Force Majeure
The Service Provider shall not be liable for failure or delay in performance caused by unforeseeable and unavoidable events beyond the Service Provider’s control (force majeure). In such cases, the parties shall consult in good faith regarding the modification or termination of the contract.
Lemondási és teljesítési feltételek
1. Lemondás módja
A Megrendelő a szolgáltatást kizárólag írásban jogosult lemondani. A lemondás időpontjának az írásos értesítés Vállalkozóhoz történő beérkezése minősül.
2. Lemondás az eseményt megelőző 60 napon túl
Az esemény időpontját megelőző 60 napon túl történő lemondás esetén a szerződéskötéskor megfizetett foglaló nem jár vissza.
3. Lemondás az eseményt megelőző 60 napon belül
Az esemény időpontját megelőző 60 napon belül történő lemondás esetén a Vállalkozó jogosult a foglalón felül
– a már felmerült, igazolt költségek, valamint
– a szolgáltatás teljesítésére lekötött kapacitás és időráfordítás ellenértékének
megtérítésére, továbbá az addig esedékessé vált díjrészek megfizettetésére az egyedi szerződésben meghatározottak szerint.
4. Lemondás az eseményt megelőző 14 napon belül
Az eseményt megelőző 14 napon belüli lemondás esetén a Vállalkozó jogosult a teljes szerződéses díjra, tekintettel arra, hogy az adott időpontra lekötött szolgáltatás rövid határidőn belül más megrendeléssel jellemzően nem helyettesíthető.
5. Vállalkozó általi felmondás és a teljesítés módja
Amennyiben a szerződés a Vállalkozó érdekkörében felmerült okból hiúsul meg, a Vállalkozó köteles a megfizetett foglaló kétszeres összegét visszafizetni.
A Vállalkozó jogosult a szolgáltatás teljesítésébe munkatársakat és alvállalkozókat bevonni. A Megrendelő tudomásul veszi, hogy a Vállalkozó személyes jelenléte az eseményen nem feltétele a szerződés teljesítésének, amennyiben a szolgáltatás a szerződésben foglaltak szerint, megfelelő minőségben megvalósul.
6. Fizetési ütemezés
A pontos fizetési ütemezést és az esedékes díjrészleteket az egyedi szerződés tartalmazza.
7. Vis maior
A Vállalkozó nem felel a szerződés nem vagy késedelmes teljesítéséért olyan előre nem látható, elháríthatatlan külső ok (vis maior) esetén, amely a Vállalkozó ellenőrzési körén kívül esik. Ilyen esetben a felek kötelesek egyeztetni a szerződés módosításáról vagy megszüntetéséről.
